1. Definitions The domain name www.teachersearchconsultancy.com ( hereinafter referred to as “Website” is owned by Ms. Deepa Shah and Ms. Payal Shah incorporated under Live Teachers Search Consultancy with its registered office at LP House, 3, Shreyas Colony, Opp Sports Club of Gujarat, Stadium Cross Roads, Navrangpura 380014 (herein after referred to as Live TSC).
1.1 In this conditions the following words and phrases shall have the following meaning unless the context requires otherwise:
1.1.1 Candidate: a person who registers himself/herself with Live TSC for the purposes of finding a job with Institution. Such registration may be for finding a job as a teacher or as a non-teaching staff.
1.1.2 Institution: School/s and/or coaching classes registered or to be registered with TSC for filing vacancies for teaching and/or non-teaching staff.
1.1.3 Resume: the curriculum vitae or brief outline details of a Candidate’s education, training, skills and employment experiences which is submitted to the Website by a Candidate for securing employment in Institution.
1.1.4 Use is either a job seeker/Candidate or an employer Institution or any other person/entity who avails of any services of Live TSC whether or not registered on www.teachersearchconsultancy.com.
1.1.5 Date of Commencement:
1.1.6 Date of Termination
1.1.7 Registration Data: It is the database of all the particulars and information supplied by the User on initial application, including but not limited to User’s name, telephone number, mailing address, e-mail address etc.
2. Acceptance of Terms
2.1 Your use of the Website and services are governed by the following terms and conditions (“Terms of Use”) as applicable to the Website including the applicable policies which are incorporated herein by way of reference. By mere use of the Website, you shall be contracting with Live Teachers Search Consultancy and theses terms and conditions including the policies constitute your binding obligation with www.teachersearchconsultancy.com. These “Terms of Use” which may be updated by us from time to time without notice to you. You can review the most current TOU at any time at: Terms of Use.
2.2 When you use any of the services provided by us through the Website, including but not limited to job postings, resume services etc. You will be subjected to the rules, guidelines, policies, terms and conditions applicable to such services and they shall be deemed to be incorporated in this Terms of Use. By accessing and using this site in any manner you agree to be bound by the Terms of Us. If you do not agree to the Terms of Use, do not access or use the Site.
2.3 We reserve the right, at our sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time without any prior written notice. It is the responsibility of the clients/customers to review theses Terms of Use periodically for updates/changes. Your continued use of the Website following the posting of changes will mean that you accept and agree to revisions.
3. Nature/Description of Services
3.1 Live TSC provides its unique recruitment consultancy services exclusively in the field of education. Live TSC acts as a matchmaker of educational industry.
3.2 Live TSC provides its two-fold services to the Institution i.e by helping the institute filling up its vacancies both in the areas of teaching and/or non-teaching staff.
3.3 Live TSC provides an easy registration process for the Candidate/s, wherein they are can categorically provide their preferences and access the best of the opportunities available, in accordance with their Resume.
3.4 Live TSC provides the best of its services by filtering the job applications as per Candidate’s preferences and the requirement of the Institution. It does not give direct access to either the Institution or the Candidate to view any other profile, except the personal profile.
4. Registration Obligation
4.1 In consideration of your use of the Services, you represent that you are of legal age to form a binding contract and are not a person barred from receiving services under the applicable laws of your residence and other applicable jurisdiction.
4.2 You also agree to:
4.2.1 provide true, accurate, current and complete information about yourself as prompted in the Registration Form (“Registration Information);
4.2.2 maintain and promptly update the Registration Information to keep it true, accurate, current and Complete.
4.3 In order to access the services offered by the Website and/or Live TSC, you must register to create an account (Candidate Account) and become a member.
4.4 If you provide any information that is untrue, inaccurate, not current or incomplete or www.teachersearchconsultancy.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, www.teachersearchconsultancy.com reserves the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
5. Privacy Policy Registration Information and certain other information about you are subject to our Privacy Policy. You understand that through your use of the Service you consent to the collection and use (as set forth in the Privacy Policy) of this information. Privacy Policy can be accessed at Privacy Policy.
6. User Account, Password and Security
6.1 During the Registration process, you will be designated a user name and password. You are responsible for maintaining the confidentiality of the user name and password. You may not have more than one (1) active Live TSC Account.
6.2 You are solely responsible for maintaining confidentiality of the account and associated password and fully responsible for all activities that occur under your account. You agree to immediately notify to us of any unauthorized use of your account or any other breach of security. You agree to ensure that you Logout and exit from your account at the end of each session. The Website cannot and will not be liable for any loss or damage arising from your failure to comply with this.
7. Indemnity
7.1 You agree to indemnify and hold www.teachersearchconsultancy.com and/or its officers, agents, employees, partners and representative harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit or otherwise make available through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another.
7.2 Notwithstanding its reasonable efforts in that behalf, www.teachersearchconsultancy.com cannot take responsibility or control the information provided by other Users which is made available on the Website. You may find other User's information to be offensive, harmful, inconsistent, inaccurate, or deceptive.
8. Consent for use/storage of data
8.1 Any Registration Information or such other information submitted on the Website may be stored on the secondary storage indefinitely or for a definite time for complying with the applicable land laws.
8.2 You agree that www.teachersearchconsultancy.com can collect certain personal information such as your IP Address and can automatically store it on the database of the Website. Such information may include, without limitation, your name, email address, contact address, mobile/telephone number(s), sex, age, occupation, interests, credit card information, billing information, financial information, content, IP address, standard web log information, information about your computer hardware and software and such other information as may be required for your interaction with the services and from which your identity is discernible. We may also collect demographic information that is not unique to you such as code, preferences, favorites, etc. Further, sometimes you may be asked to provide descriptive, cultural, preferential and social & life style information.
8.3 You agree and confirm that any such Information so collected through your registration on www.teachersearchconsultancy.com can use, transfer, process and store such Information in any manner whatsoever. The Information collected may be shared with Institutions whose need matches Candidate’s preferences and by agreeing to this terms and conditions grants explicit permission and approval for the same. You agree and confirm that no sensitive/personal information has been shared by you with www.teachersearchconsultancy.com.
9. User’s Obligations
9.1 The Accuracy of the Registration Data given to Live TSC on initial application for the Service shall be the sole responsibility of the user.
9.2 The User agrees not to assign and/resell the rights and obligations under this terms and conditions. The user further agrees that it shall not reproduce, duplicate, copy, sell, trade, resell or exploit for commercial purpose, any portion of the Service (including its User ID), use of service or access to the Service.
9.3 The User confirms that he had obtained all licenses and permits which are necessary for posting and uploading a job listing on the Website. The User indemnifies and agrees to keep Live TSC indemnified against all demands, claims and damages which may arise out of the said job.
9.4 The User will ensure compliance with all notices or instructions given by Live TSC from time to time to enable the use of the Services.
9.5 The Service shall not be used by the User to send or receive any message, which is offensive on moral, religious, racial or political ground or of an abusive, indecent, obscene, defamatory or menacing nature.
10. Dealing with the Candidate/Institution
10.1 All the User/s agree that to have an access to any of the service/s provided by www.teachersearchconsultancy.com, they shall have to first register with Live TSC and create their own personal profile.
10.2 As a promotional offer, registration for the Candidates is currently free of cost, which may be charged at a future date by amending these terms and conditions.
10.3 Those Institute/s who want to avail the services shall first create a profile on the Website. On creation of such profile, agents/employees/partners and or such other authorized person/s of Live TSC would go and meet the authorized representative of such institution in person. The Institute thereafter have to pay to Live TSC a sum of Rs. 8,000/- (Rupees Eight Thousand Only) in the form of onetime registration fees.Such preliminary registration shall be followed by a formal contract to be entered between Live TSC and the Institute. The Institute upon registration agrees to bind by the terms and conditions of such Contract and they shall form a part of this Terms of Use.
10.4 The Institute further undertakes to review its profile from time to time to update and/or close its vacancies for teaching and non-teaching staff.
10.5 The Institute shall not place any vacancies for a position which is fake, non-existent or requires the Candidate any amount upfront or anytime later to get a job or promise of a job.
10.6 Live TSC reserves the right to terminate the account and forfeit payments (if any), if a User is found to be engaged in any unlawful activity including but not limited to Job scam, Email spam etc.,
11. Modification of Services Live TSC reserves all the rights to modify, discontinue, temporarily or permanently, the Services or any part thereof with or without notice. The User agrees that on occurrence of such an event, Live TSC shall not be responsible and/or liable to the User or any third party for such modifications, suspension or discontinuance of the Services.
12. Termination
12.1 Live TSC may at its sole discretion, without giving any prior notice, terminate User account and access to the Service. Reason/s for termination without limitation are as follows:-
12.1.1 Breach or violation of the Terms of Use or other incorporated agreements, policies or guidelines.
12.1.2 To comply with provision, order of guidelines of law
12.1.3 On request by the user for such termination/deletion
12.1.4 Extended period of inactivity.
12.1.5 Discontinuance or material alternation in services
12.1.6 Engagement by User in fraudulent and/or illegal activities
12.1.7 Non-payment of any fees owned by you towards the Services
12.2 Termination of the User Account includes (not limited to):
12.2.1 Immediate Prohibition on access to all services offered by the Website.
12.2.2 Deletion of the account including the user name and password and prevention of further access to the services at any future date.
13. Compliance of Law The User does hereby specifically agrees that he/she/it shall at all times, comply with the requirements of the Information Technology Act, 2000 and other applicable laws as also rules and regulations, guidelines, bye laws and notifications made thereunder from time to time. The said User further declares that in case of any violations of any applicable laws and/or rules, regulations, guideline, byelaws and notifications made thereunder, he/she/it shall be solely liable for civil or criminal liability.
14. Generally
14.1 Live TSC shall not be liable to Users in respect of any loss or damage (including consequential loss or damage) which may be suffered or incurred or which may arise directly or indirectly in respect of:
14.1.1 the services provided.
14.1.2 Unavailability of Services (by virtue of interruption, suspension or termination) of www.teachersearchconsultancy.com for the reasons such as computer or communication link downtime attributable to malfunction, upgrades or preventive or remedial maintenance activities.
15. Prohibited use
15.1 The resume database features of www.teachersearchconsultancy.com may be used only for lawful purposes by candidates seeking employment and career information and institutes seeking employees. It specifically prohibits any other use of the site, and all Users agree not to do any of the following:
15.1.1 Post jobs or content on the Website that contain any hyperlinks, HTML tag, hidden keywords or any keywords that are irrelevant to the job or are otherwise misleading;
15.1.2 Post or submit on the Website any incomplete, false or in accurate biographical information or information which is not your own;
15.1.3 Send unsolicited mail or e-mail, making unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to any other User or on the Website;
15.1.4 Delete or revise any material posted by any other person or entity;
15.1.5 To duplicate, download, publish, modify and distribute material on the Website unless specifically authorized in writing in this regard.
15.1.6 Aggregate, copy or duplicate in any manner any of the contents or information available on the Website
16. Disclaimer of Warranties
16.1 You expressly understand and agree that our use of the services is at your sole risk. The services are provided on an "As is" and "As available" basis. Except as otherwise stated herein, we expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to any warranties of title, the implied warranties of merchantability, fitness for a particular purpose and non-infringement and any warranty for information, data, services, uninterrupted access or products provided to or in connection with the services.
16.2 We make no warranty that (1) the services will meet your expectations, (2) the services will be uninterrupted or timely (3) any errors in the services will be corrected, (4) that the services or software are secure, free from bugs, viruses, or other program limitations.Some states do not allow the exclusion of implied warranties, so the above exclusions may not apply in whole or in part to you. In that event, except as prohibited by law, any implied warranties are limited in duration to 60 days from the date of purchase of the services
16.3 All warranties and guarantees given or made by us with respect to the services (1) are for the benefit of the registered user of the services only and are not transferable, and (2) shall be null and void if you breach any this Terms of Use.
16.4 All the contents of this Website are only for the general information use. They do not constitute advice and should not be relied upon in making or refraining from making any decision.
16.5 This disclaimer of warranties and liabilities applies to any damages or injury caused by any failure or performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of or use of record or services, whether for breach of contract, tortious behavior, negligence or under any other cause of action.
17. Limitation of Liability
17.1 Live TSC shall not be liable for any false or untrue information submitted by the Candidate and/or the Institute.
17.2 In case of Candidates, Live TSC may do a general background check, but it is the responsibility of the Institute to verify the details including academic details submitted by the Candidate. No liability shall accrue on the Website and/or Live TSC for any fraudulent data so submitted.
17.3 Live TSC will not be liable (whether in contract or tort) for :
17.3.1 Any loss of data, Resumes or other materials that the Candidate supplies to www.teachersearchconsultancy.com. 17.3.2 Any mistakes or errors whatsoever that arise during the course of use of the Services or any loss of information or data or any damage thereto in each case as a result of circumstances beyond its reasonable control or which arise as a result of the acts or omissions of the User. 17.3.3 For any failure to secure employment or consequential loss (whether caused by the negligence of www.teachersearchconsultancy.com, its employees or its agents).
17.3.4 Any delay, costs, expense, loss, damage or liability (including without limitation as a result of any use of software, virus, deletion, corruption, loss or removal of data) howsoever caused arising from any matter beyond the reasonable control of Live TSC or as a result of the acts or omissions of the Candidate.
17.3.5 Any loss or damage whatsoever howsoever caused arising out of the negligence, dishonesty, misconduct, breach of faith, incompetence, or the wrongful disclosure of confidential information by, any User. It is for the Candidate to satisfy itself as to the integrity and reliability of the Institute/s.
17.3.6 Any breach of agreement or infringement or violation of any right of any person or be rendered liable to any proceedings whatsoever, as a result of any information or Resume or Application submitted to it by the Candidate and the Candidate indemnifies Live TSC against all costs, claims, damages, loss, expenses and liabilities suffered or incurred by Live TSC as a result of this undertaking and warranty being incorrect.
17.3.7 The Candidate agrees and acknowledges that no condition, warranty or representation of any kind is, has been, or will be, given by or on behalf of Live TSC in respect of or in connection with the Services and accordingly the Candidate confirms that it has not, in accepting these Conditions, relied on any condition, warranty or representation by Live TSC or any person on its behalf, express or implied, whether arising by law or otherwise in relation to or in connection with the Services. The benefit of any such condition, warranty or representation by Live TSC is hereby irrevocably and unconditionally waived by the Candidate.
18. Third-Party beneficiaries Except as otherwise expressly provided in this Terms of Use, there shall be no third-party beneficiaries to this Agreement.
19. Intellectual Property Rights
19.1 The Mark “Live TSC” is a registered trademark, registered in the name of http://www.teachersearchconsultancy.com.
19.2 Any material/s posted on the Website is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.
20. Applicable Law This Agreement and any dispute including interpretation of these terms of use and/or matter arising from the use including incidental use of www.teachersearchconsultancy.com shall be governed by the laws of India. The User hereby submits to the exclusive jurisdiction of Courts at Ahmedabad, Gujarat.
